This Privacy Policy ("Privacy Policy" or "Policy") describes the practices of Owlue LLC ("Owlue," or "we," or "us," or "our") with respect to the collection and use of your personal information during your visit to our website and mobile application online and offline or your use of our products and services (collectively, the "Services") and the rights you may have with respect to your personal information. By using this website and otherwise interacting with us, you agree to the terms of our Terms of Use and Privacy Policy. This Privacy Policy does not cover the personal information we collect about employees and independent contractors or job applicants.

Personal Information We Collect

We collect your personal information when you use our Services or any of our interactive features, create an account with us, use our Services to provide property-related information to us or obtain information regarding your property tax appeals, file your property tax appeals, request information from us, contact us for customer support, provide your inquiries, feedback or complaints, call or email us, or otherwise interact with us. We also collect personal information about you from third parties, including but not limited to third-party public databases, property data aggregators, and third parties that you choose to use when signing up for an account with us, such as your Google account.

We collect the following categories of personal information:

  • Personal identifiers: your name, email address, mailing or property address, telephone number, account name and password, IP address, and any personal identifiers contained in customer submissions, inquiries, reviews, feedback or complaints
  • Commercial and property-related information: your street address, city/state/zip code, parcel number, school district, property characteristics including square footage, lot size, number of bathrooms/bedrooms, year(s) that the property was built, the latitude and longitude GPS coordinates of your property, assessed property value, property tax amounts, purchase and sale prices and dates, other property-related information provided by you, and records of services you obtained or considered
  • Professional information: job title, work email address, company name and other information about your employer or company, including your employer's or company's name
  • Internet or other electronic activity information: your device and browser type, your operating system, your browsing and search history on our Services and information regarding your interaction with our Services and our advertisements

We do not engage in the automated processing of personal information to create profiles about individuals that are used in furtherance of decisions with legal or other similarly significant effects, such as the provision or denial of financial or lending services, housing, insurance, or access to essential goods or services.

Purposes for Collection of Personal Information

We collect your personal information to provide our Services; to create, authenticate and manage your account; to provide you with the information you request from us including but not limited to displaying results regarding your property such as your property market value, over-assessment amount(s), savings estimate(s), confidence score(s), and property tax appeal strength; to obtain additional information regarding your property including property records and assessments, school boundary data, comparable property sale and purchase data from third-party data aggregators and public databases; to handle and manage your property tax appeal filings, follow-ups, and municipal responses; to contact you from time to time; for customer support; to deliver advertisements and marketing promotions and offers about products we think may be of interest to you; to respond to your inquiries, feedback or complaints; to customize your experience, and to audit and analyze the placement and effectiveness of our advertisements and other marketing efforts.

We also use your personal information about your use of our Services to monitor and improve our Services; for internal business analysis; to prevent fraud, activities that violate our Terms of Use or that are illegal; and to protect our rights and the rights and safety of our users or others. For those who interact with us in a commercial capacity, we use your personal information to engage in business transactions with the entity you represent and market to or engage in diligence with the entities you represent.

Disclosure of Personal Information for Business Purposes

We disclose your personal information we collect through our Services with service providers that help us operate our business, including property data aggregators to obtain additional information regarding your property or properties such as comparable property sale and purchase data, school boundary data, property ownership records, and other related property records and assessments; third parties that provide mail and filing services to assist us in filing your property tax appeals; and other third parties that provide security services and cloud-based data storage, host our website, assist with other IT-related functions, secure our IT systems, provide website and other business-related analytics, prevent fraud and other illegal activities, facilitate email communications, and provide legal and accounting services.

We also disclose your personal information to governmental entities, including but not limited to a county assessor or county assessment appeals board to file and facilitate your property tax appeals. Furthermore, we disclose your personal information as required or permitted by law to comply with a subpoena or similar legal process or government request, or when we believe in good faith that disclosure is legally required or otherwise necessary to protect our rights and property or the rights, property or safety of others, including to law enforcement agencies, and judicial and regulatory authorities.

We disclose your personal information to third parties to help detect and protect against fraud or data security vulnerabilities. Furthermore, we may disclose or transfer your personal information to a third party in the event of an actual or potential sale, merger, reorganization of our entity or other corporate restructuring.

Use of Artificial Intelligence

Aside from entering and using your property address, we do not input any personal information into any third-party artificial intelligence ("AI") technologies to provide our products and services to you, nor do we allow any personal information to be retained or used for AI training purposes by third parties.

Our Use of Cookies and Analytics

We may use cookies, pixel tags, web beacons and other similar tracking technologies ("tracking technologies") to automatically collect information through our Services. Tracking technologies are small data files placed on your computer, tablet, mobile phone, or other devices that record certain pieces of information when you visit or use our Services. We may use these tracking technologies to help identify irregular behavior, prevent fraudulent activity and improve security, as well as making it possible to customize your experience, provide our Services and help us understand how you interact with us.

We also allow third parties (including Google, Meta, and Hotjar) to use third party cookies, web beacons, and other storage technologies to collect or receive information about how you interact with our Services and elsewhere on the Internet and use that information to provide analytics and other measurements services, and to deliver and target advertisements tailored to you. Third parties may also use some of these technologies to assist us in determining if you require assistance or are having problems navigating on our Services, and this may include technologies that record your interactions with our Services, including without limitation, your keystrokes, mouse clicks, screen touches, and information about when, how and from where you accessed our Services. We use Hotjar on our Services in order to better understand how our users interact with our Services and to optimize our Services and user experience. Hotjar allows us to visualize user interactions that helps us better understand our users' experience to improve our Services by identifying issues and friction points. To provide these services, Hotjar uses first-party cookies and other technologies to collect personal data on our users' behavior, and their devices on our behalf. This may include personal data like online identifiers (e.g. device's IP address, user ID), technical data (e.g. device type and screen size, browser information), behavioral data (interactions with our website/app such as clicks, taps, scrolls), and any additional information that we submit through Hotjar. We use Google Analytics to evaluate the use of our website. Google Analytics uses cookies and other identifiers to collect information, such as how often users visit our website, what pages they visit when they do so, and what other websites they visited prior to visiting our website. SMS Consent and Terms and Conditions

If you have consented to receive text messages from us, you may receive text messages about updates regarding your property tax appeals, including but not limited to the status of your appeal filings and/or the outcome(s) of your appeals. Message rates may apply and messaging frequency may vary. You may opt out of receiving text messages by texting STOP or can receive assistance by texting HELP. Links to our Terms of Use and Privacy Policy will also be provided. Any information obtained as part of your consent to receive text messages from us will not be shared with third parties or affiliates for marketing/promotional purposes. This information will only be shared with service providers that assist us in operating our text messaging service for the purpose of sending you SMS updates regarding your property tax appeals.

Personal Information of Minors

Our products and services are not directed to minors under the age of 13, and we do not knowingly collect the personal information of minors under the age of 13.

Do Not Track Signals

Do Not Track (DNT) header signals allow users to tell certain websites not to track their online activities. Because there is no current industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

California Shine the Light Law

California Civil Code Section 1798.83, also known as the "Shine the Light" law, permits California residents that have an established business relationship with a business to annually request, free of charge, information about certain categories of personal information a business has disclosed to third parties for those parties' direct marketing purposes in the preceding calendar year. We do not disclose personal information to third parties for their own direct marketing purposes.

Third Party Websites

Our Services may contain links to third-party websites, including social media buttons that link to social media platforms. This Privacy Policy does not govern how those third parties or social media platforms collect or use personal information and we do not endorse or have control over their practices. The privacy policies and terms of use for those third-party websites/apps or social media platforms govern those companies' privacy practices. We are not responsible for the content or privacy practices of any third-party website/app or social media platform.

Securing Your Personal Information

We implement and maintain reasonable security appropriate to the nature of the personal information that we collect, use, retain, transfer or otherwise process. However, there is no perfect security, and reasonable security is a process that involves risk management rather than risk elimination. While we are committed to maintaining a reasonable information security program, no such program can be perfect; in other words, all risk cannot reasonably be eliminated. Data security incidents and breaches can occur due to factors that cannot reasonably be prevented. Accordingly, it cannot be assumed that the occurrence of any given incident or breach results from our failure to implement and maintain reasonable security.

Changes to This Policy

We will review and update this Privacy Policy from time to time. If changes are made, we will update the Privacy Policy and reflect the date of such modification in the "Last Updated" date above. If the changes are material, you will be notified via email or a notice on our website.

We provide residents of certain U.S. states with rights with respect to the personal information we collect about them under their state's data privacy law. The rights provided under these laws are similar in many respects, with some differences from state to state. These rights will be provided to residents of U.S. states with data privacy laws that apply to us.

  • Right to Know: The right to know whether we are processing your personal information.
  • Right to Access / Copy: The right to access or request a copy of your personal information, subject to certain exceptions.
  • Right to Delete: The right to request deletion of your personal information that we have collected from or about you and to have such information deleted, subject to certain exceptions.
  • Right to Correct: The right to request that we correct inaccuracies in your personal information.

Exercising Your Rights

We will respond to requests from residents of states with data privacy laws that apply to us and will do so with respect to the rights that are provided as of the effective date of each law. We will provide a substantive response to these requests within 45 days of the date on which we receive your request, to the extent your state law applies. If we require additional information or time to process your requests, we will contact you.

Verification of Requests

When you exercise certain rights, we will take reasonable steps to verify your identity. We will ask you for at least two pieces of personal information, depending on the nature of the request, and attempt to match those to information that we maintain or collect about you. If we are unable to verify your identity with the degree of certainty required, we will not be able to respond to the request. We will notify you to explain the basis of the denial.

When We Do Not Act on a Request

In some cases, we may not act on your requests (e.g., if we cannot do so under other laws that apply). When this is the case, we will explain our reasons for not providing you with the information or taking the action (e.g., correcting data) you requested within 45 days of the date on which we receive your request, to the extent your state law applies. Additionally, residents of certain states have the right to appeal our decision by contacting us at privacy@owlue.com within 30 days after your receipt of our decision. We will provide a substantive response to any appeal request within 60 days after our receipt of your appeal request. If your appeal is denied, we will provide you with information on how to contact your state Attorney General.
